They were more sympathetic than the men because they themselves knew the flight it took to run a household, to which the men disregarded. The women were the ones that asked questions. They pondered whether or not she had a happy and stable marriage, going through many reasons as to what could have led her to commit such a crime. While the men were busy investigating upstairs, it was the women who found the bird cage as well as the dead bird in the sewing box. They compared Mrs. Wright to the bird in line 449. She come to think of it, she was kind of like a bird herself real sweet and pretty, but kind of timid and fluttery. How-she-did-change. The women based their findings on facts and evidence as opposed to the indifferent attitude of the men. The mens judgments on women did not allow them to accurately and objectively assess the case where as the women we able to see things that the men overlook. However, though the men were not able to gather more evidence for the case, the women were the ones who found possibly the most important finding, which was the broken bird cage as well as the dead bird. Even after finding the bird, the women decided to commit a crime themselves by hiding the bird from the sheriff. Even though the women were more sympathetic they were still wrong for hiding the evidence. Thus alluding to the fact that the womens emotional nature disabled them the same way as the mens judgmental attitude.

However this suppression is not applicable under a number of varied circumstances to include the defense of sovereign immunity asserted by any State or by the Federal Government of the United States. The Federal law except the Federal Employees Compensation Act and the Longshore and Harbor Workers Compensation Act, the Foreign Sovereign Immunities Act of 1976, the State choice-of-law rules, the right of courts to transfer the venue or apply it to a foreign nation or to dismiss a claim of any foreign nation or citizen on grounds which state that this is an inconvenient forum and also any statutory or common law cause of action including action to abate a nuisance, that authorizes a state or person to institute action for civil damages or civil penalties, clean up costs and so on. In Title III, a person is permitted to seek recovery for harm which has been caused by a product through civil action against the manufacturer or seller under applicable or Federal law to the extent that such law is superseded by the Act. It establishes a standard for liability by a product seller for the causes of the harm which can fall under categories of negligence or express warranty. The conduct of the seller can be examined with respect to a variety of factors such as construction, inspection or condition of the product and for not passing on the warning or instructions from the manufacturers only in case these have not been forwarded when the item was in his possession or has not made reasonable efforts to provide the users with the warning and instructions. The seller is treated as a manufacturer and is liable for damage caused in case the manufacturer is not effective to service of process in any State in which the action could have been brought which is relevant in the case of the hypothesis wherein the Federal laws are said to be applicable in states under the Act. Punitive damages are however proscribed against a manufacturer or seller of a drug or medical device where the drug or the device has received the pre market approval of the Food and Drug Administration (FDA); and the drug has been accepted as safe under conditions approved by the FDA. Similar protection is provided to manufacturer of aircraft which have been subject to pre-market certification by the Federal Aviation Administration (FAA). The factors to be considered in determining the amount of punitive damages have also been covered. (c) It was referred to the Committee on Judiciary by unanimous consent in June 1992. (d). After consideration by the Judicial Committee it was placed for consideration in Senate by Unanimous Consent on 8 September 1992. (e) Cloture motion to proceed was presented and withdrawn on 8 September 1992. (f) Cloture to proceed was not invoked in Senate by Yea-Nay votes on 10 September 1992 and again not invoked on reconsideration by Yea – Nay vote of 58 – 38. (g) There after this was not pursued further. However the Act in a modified form and through a separate motion has came into force in 1995. The issue before us is however that of liberals being federal focused vis a vis the conservatives. The bill was designed to regulate inter state commerce and provide a uniform product liability law as per the title. It was extensively for the benefit of the individual and the consumer and for all purposes should have been considered by the Senate and approved. However it appears that the underlying clauses in the Bill as given below which restricted the powers of the state could have contributed to its rejection for cloture:- (a) It declared that U. S. district courts did not have jurisdiction over any civil action under this Act, based on specified provisions of Federal law relating to district court jurisdiction. (b) Superseded any inconsistent State law regarding recovery in such actions. A quantitative analysis of the votes has been carried out in the Tables 4 to 6 given below. An examination of Table 4 will reveal that the overwhelming votes of Republicans, 40 have not been in favor of cloture of the legislation with only three for it. The liberal opinion has been with 18 not in favor of the cloture and 35 for it. This clearly indicates that the Republicans were not in favor of restricting the powers of the states even when these were in favor of the individual and also affected the regulation of commerce. This would have avoided a number of vexed issues arising out of inter state commerce which could have been smoothened. But the lack of cloture prevented from such a logical course taking place. The Republican bias towards state independence once again proved to be the stumbling block. An evaluation of the percentages polled will amplify this aspect further for which Table 5 may be examined. The Republicans have voted with an overwhelming 93. 1 percent against the cloture while 66. 1 percent of Democrats were in favor of the cloture. Thereby establishing that a majority of liberals do vote in favor of such motions which provide for federal control on issues which impinge on state – federal relationship. In case the voting is examined quantitatively in terms of percentage of voting in terms of Ayes and Nays with party affiliation, it would emerge that 68. 9 percent Republicans and 31. 1 percent Democrats had voted against the cloture and only 7. 9 percent Republicans and 62. 1 percent Democrats were for cloture. Thus the Democrats are deemed to be overwhelmingly in favor of the cloture.

Cricket The game Cricket is I have selected for this assignment. Cricket is a sport, which is played between two teams of eleven players each by bat and ball. There are 15 players in one team but only eleven can play. A cricket match is played on a grass field (ground), in the centre, there is a pitch of which is a flat strip of ground 22 yards long. At each end of the pitch, there is wicket of a set of wooden stumps. A player from the fielding team (called the bowler) drive forward a hard, fist-sized cork-ball in from one wicket towards the other. The ball usually bounce once before reaching a player from the opposing team (called the batsman), who defends the wicket from the ball with a wooden Bat. The batsman, making runs between the wickets, with the help of non-striker till he is not given out. Non-striker is standing in near the bowlers wicket and plays an inactive role, to make runs. The other members of the fielding team stands in various positions around the field as fielders. The match is won by the team that scores more runs at the end of the match. Cricket was established before approximately hundred years ago in England. Cricket is the most popular sport in the South Asia, such as India, Pakistan, Bangladesh, and Sri Lanka,. It is also a major sport in other countries such as England and Wales, Australia, New Zealand, South Africa, Zimbabwe, Bermuda, and West Indies. Batting and bowling are the main factor of the cricket. The aim of the batting team is to score runs as much as possible. When both batsmen successfully move to their respective opposite ends of the wicket one run scored. The aim of the bowling team is to get each batsman out or dismissal and prevent the score of batting team. Dismissals are achieved in a different ways. The most directive way is that the bowler bowl the ball in such a way that it escape the batsmans guard and hits the stumps, unload the bails. While the batsmen are trying to get run and the fielders may to knock stumps by the ball before the batsman has reached the crease which is nearer to the stumps. Other way is that while the fielding side catches the ball before it touch the ground. Once the batsmen are not attempting to score any more runs, the ball is dead and is bowled again (each attempt at bowling the ball is a ball or a delivery). When a batsman dismissal on zero (0) run, called duck out, while batsman di smissal without facing a single delivery, called diamond duck out. The game is divided into overs there are six delivery of balls in each over. At the end of an over, the batting and bowling ends will be change and the bowler will replaced by another bowler of the fielding side. The two umpires also will change positions at this time, and sometimes the fielding positions also may be changed by the captain. When one batsman is given out by the umpire, he will replace by the another batsman to lineup his team. When the tenth batsman is given out, the innings of the batting team will end i.e. all out, since there are always must be two batsman on the pitch. ( in limited overs Cricket, the innings end either when the batting team is all out or the fix number of overs are bowled by the fielding. This type of cricket called as One-day-International. At the end of an innings the two teams exchange roles, the fielding team becoming the batting team and batting team becoming fielding team. The team which has score more runs at the end of the completed match, that team win the match. There are different types of the completing the match for illustrate there may be restrictions on the number of overs. The number of balls in each inning etc. A draw is not an uncommon result in Test cricket, if the team that is last to bat has not scored enough runs to win but has not been dismissed before the end of the play. Cricket is just a game between two teams, which are fighting for win. In cricket there are three types of format i.e. One Day International (ODI), Test Cricket, 20-20 cricket. In ODI there are limits 50 overs per an innings. Both team is bat and bowl alternately. Each team can play only one inning per match. Earlier there are 60 overs in an innings but now its decease up to 50 overs. Test Cricket is the five days game. There are 90 overs of limit in one day or one day ( 8 hours play ). In earlier there are six days game but now its decrease up to the five days. Both team can bat and bowl two time i.e. both team can play two innings. While in 20-20 cricket there are only 2 overs in an innings. This type of cricket recently started in 2007 to play. The Re-Creation of a Young Roman Girl At seven years old this young, upper-class1 Roman girl, daughter of a prominent political figure, is posing for a portrait of her face. As predicted by her father, Roman art historians are very interested in these portraits and the past they represent. In 1998 this bust is a rare and exceptional find among art collectors. This portrait is now one of twenty-one sculptures found in the Riley Collection of Roman Portrait Sculpture at the Cedar Rapids Museum of Art. This portrait is rare, first because it is a portrait of a child, and second because it is portrait of a young girl. Children were often exposed in ancient Rome, especially young girls. The reasons for exposure are probably monetary. Poor families could not afford many children, and wealthy families did not want to have to divide their inheritance any more than necessary. Boys were most often kept because they would be the heir to the family and preserve the family wealth, while daughters would require a dowry to be given to her husband.2 When the portrait is finished, this young girl and her two older brothers, would be immortalized in stone. Included are the reasons inmates need education in order to successfully reenter society once they are released and use the knowledge and skills they have learned to obtain a job in order to support themselves and their families. Structural functionalism and conflict theory have some different points of view. One of them is that structural functionalism sees society as a complex system, that permit it to interact cohesively, and looks society as a macro-level orientation; while the conflict theory focuses on the social system that only work for a select few of society and is known because the struggle for dominance among social groups that compete for scarce resources. Knowing this, How different structural functionalism views gender than conflict theory does in a society?Gender differences are viewed from functionalism as an efficient way to create divisions and specializing of cooperative labour into specifically circumscribed tasks and roles. Austin Beeler American and North Vietnamese Perceptions of War To the American Soldiers and the NVA/VC soldiers, the Vietnam War was both very similar and very different. Most of soldiers in Vietnam went into the war with a purpose, and they had a very high morale levels. Both the Americans and the NVA soldiers left with many problems. The war left most soldiers with very severe cases of mental issues. There were also many things about the war that differed to the soldiers. One was the type of patriotism, and the other was the consequences of choosing to not fight.The American soldiers were fighting with a different type of patriotism than the communist soldiers. The Vietnamese soldiers were fighting for their freedom and to protect their homeland. The Americans were fighting for their government. They went into the war completely trusting their government no matter what they thought about the conflict. The war left both sides with huge wounds that would take a long time to heal. The American soldiers left for Vietnam knowing that they have been the victors in all of the other wars and conflicts they have been in.The morale among the soldiers was high at the beginning of the war. The Vietnamese soldiers had very high morale after beating the French in 1954. One American soldier wrote a letter to his fiance that was supposed to be given to her in the unfortunate event of his death. He told his fiance that he is proud that he was even able to fight for his country, and even though the war has taken his life, he wishes that she doesn’t hate the war because of it. The soldiers that were first sent over seas were proud of what they were doing.They believed in their country and they believed that the people back home would have their back. The Vietnamese soldiers had been victorious in beating the French empire just years before the American soldiers arrived. They were in high spirits and it gave them a sense of invincibility because they just defeated a huge power. The Vietnamese soldiers were fighting for their homeland. They saw the Americans as another colonial power that was trying to move in and take control again. The soldiers knew that they could navigate the land much better than the Americans and they carefully planned their attacks.Both of the sides were patriotic, but they were patriotic in different ways. The American soldiers were patriotic in the sense of they were serving for their government and their country. They were fighting because the government told them that they need to be over there stopping the spread of communism. For the Americans it was about making their country proud. The North Vietnamese soldiers were patriotic in a completely different sense. They were fighting for their freedom. They thought that if they didn’t fight, then they would be put back down to a lower level than the Americans.Just like the French had done to them when they were in control. The soldiers were fighting to protect their fa milies back north and to save their land. They had an obvious purpose to fight, while the Americans couldn’t see how the war affected them back home. Both the Americans and the North Vietnamese soldiers left the war affected deeply. Many soldiers returned to their homes and they were severely affected by PTSD. In the book, Kein has nightmares every night that he tries to sleep. That includes the nights he was in the military, and the nights after the war was over.Kein was talking to one of this soldiers and he said â€Å"their chaotic minds, their troubled speech, revealed how cruelly they were twisted and tortured by the war†(20). The NVA soldiers watched thousands of their fellow soldiers die right beside them. Throughout the war, the NVA/VC lost over a million soldiers. Seeing that many people die affected the soldiers greatly. One of the soldiers in Keins battalion is severely depressed and is thinking about deserting the rest of the soldiers and heading home. Kein tells him its suicidal and shameful. Can saying â€Å"Suicidal? Killing myself?I’ve killed so often it wont mean a thing if I kill myself. As for the shame†¦ In all my time as a soldier, I’ve never seen anything honorable†, shows how desensitized the soldiers are. They don’t care about death anymore. Many of them embrace it because they know its coming. The American soldiers were just as scarred by the war. One of the soldiers that reflected on the war in 1984 basically said that depression kills you faster than a bullet to the head. It â€Å"eats away at you inner being. It eats away at everything that you ever learned (5). † The soldiers with depression didn’t get help from anyone.The only people they got help from were the psychiatrists they paid to go see. Both sides used drugs to help cope with the sorrows of war. The Vietnamese soldiers smoked the Rosa Canina flower, and the American soldiers smoked marijuana and used heroin. The drugs helped the soldiers deal with the depression of war. The war was a very tough place for both sides. Both countries had a very hard time recovering from the war, but the people who had to overcome the most were the soldiers. They went through so many things in war that they left Vietnam with â€Å"young shoulders that bore rather old heads (2). †

Various healthcare organizations are now working with a huge chunk of data. The database is consisted of this chunks of data organized in a proper manner. The information is derived from the data that are collected by the system. The Information System is the piece of technology that assist an organization to manage the data and process the data to generate information. The information system also responsible for generating reports based on information that assist the management and doctors to take decision precisely. The report is consisted of discussion on two subsystems of the James Healthcare Organization. The sequence diagrams have been developed based on the patient registration sub system and appointment scheduling sub system. The report also provide the ways of modifying the designs to make it more effective.   James Healthcare Center is a renowned organization that operates its business based on twelve thousand patients and four hundred and fifty staff. The owner of the organization is currently thinking of opening a new center that will consists of all the modern medical facilities. The organization provide insurance coverage to its employees. The need of the modern technology and information system is required to support the business growth. The new system will be replacing the old paper based processes of the organization. The office manager supervises all the employees of the organization. The HR handles the staff benefit and human resources. Lee Sue is responsible for managing the appointments of the healthcare. He has to maintain the appointment related data single handedly. This is a critical and effortful process. The possibility of errors is very high. The patient registration is s crucial process as it is consisting of the data that will identify the patient. The project will be developed using the agile methodology where the organization will be able to develop the system based on the prototype development. The designs of the project is created on the OO design. The system will be responsible for making the reports for management so that they can facilitate the decision making. The clinical decision making system will be integrated into the system so that clinical treatment decisions can be taken properly. Electronic Medical Record is the data storing technology that will hold the patient treatment related data. The EMR will hold the patient details, diagnosis details and its results, the test reports, the doctors who are providing treatment, the medicines that are prescribed to the patient and the effect of the medicines and much more. The project is consisted of various parts and development of various subsystems. These subsystems will be developed individually and then bined to create the plete system. The system will be running on a single server. The project will be developed using various programing languages. Database that can store business and patient health related data for a very long time. The ERM will be integrated into the system to hold the patient health and treatment related data. A CDSS or clinical decision support system that can facilitate the decision making process of the system.   The deliverable of the project are as following. The main constraint of the project is designing of the system. The system design is based on the ou e of the requirement analysis process. If any issues occurs in the requirement analysis process then the system project will fail. Managing the change in the organization is a considerable issue. The main requirements of the system are human resource, support of the stakeholders, programing language, database, network and many more. The programming language is used for making the GUI and the backend coding of the system. The functionalities of the system will be developed using the programming language. The data base will allow the system to hold the data in a secure location. The database has to be accessed through a predefined queries based on the database type. The deigning software is a crucial requirement of the project. The software will be used for designing the system functions and interactions with the end users. The software form third parties and the hardware to setup the system are also significant requirements of the system. The system network will be developed using the wireless method. All the client devices of the network will be connected using the Wi-Fi.   The advantages of the project are as following. The diagrams has been done properly to establishing a fine understanding of the sub-system processes. At the beginning, the patient will open the application or website (which is no concern of the report) and enter the details. The details will be consisting of the data like patient personal data such as name, address, spouse, age, email address, phone number and many more. It is to be assumed that a patient may want to open various accounts on the system to cheat the organization or may forgot he has one existing. In such cases, the system will verify all the details provided by the patient to ensure that the patient does not have any previous account. The patient will input the id and password of his wish to the system so that using the id and password the patient can later login to the system. The system will then read the inputted registration details and convert it into the machine readable values. The system will be developed using the object oriented language like java, python or any other. The system development will be based upon the OO designs. The designs have to be as per the proposed scope of the system. The designs will be created using the user data that are provided during the requirement analysis process. In this diagram the patient has been the actor who will trigger the system functionalities. The patient object will trigger the registration function mentioned as the `register()` in the diagram. The register function will be acting upon the defined variables which will be initialized based upon the user input. The variables will then be used by the system to verify user and register patient after success verification. The system design has been done with pleteness as it is consist of all the processes that are required to register the patient. It is mon in the healthcare industry that a patient ing from a doctor who has been providing treatment to the patient. The system will hold the data of the doctor so that it can be used for future decision making purpose. The system will be storing the daises of the patient that is already known so that assistance can be provided during treatment. The EMR will hold the data like to which medicines the patient has allergy and more. As this data will be recorded during diagnosis, these data will not be considered at this sub-system development.   Figure 1: Patient Registration Subsystem Sequence Diagram Verification and Analysis: The payment registration will also be done by only the interaction of the patent. No receptionist or other staff of member will be handling the appointment process anymore. The system will hold the appointment related data into the system and based on these data and patient desired appointment details, the new appointment will be scheduled. The system will be collecting the data form the patient through the GUI provided to him/her. The patient will access the system and login to the system using id and password. A session will initiate and the patient id will be used for storing the activities. The patient will request for appointment through the schedule appointment section in the GUI. The user will input the date desired for appointment and the type of the specialist. Selecting the physician is based upon the system it is not up to the patient. After getting all the data from the user, the system will retrieve data from the database. These data will be about the appointment scheduled the preferred day against the selected physician type. If the system fids that the appointment data is vacant in that day then the appointment will be scheduled and if not then the system finds for an alternative day. The patient will select an alternative date. After the patient select the alternative day, a notification will appear in the screen saying the ‘Appointment will be confirm. Are you sure of the date?’ If the patient select ok then the system will confirm the appointment against the patient. The system sequence diagram did not include any information regarding the verification process. Each of the data must be verified so that only authenticated data can be inserted into the system. The sequence diagram can be developed by dividing all the processes into the sub-processes so that all the system functions can be understood properly. Form the above report it can be concluded that the system development process can be difficult task but if done properly then can invite many opportunities for JHC.
